Amendments in the payment of contributions to the Social Protection Fund of the Ministry of Labor and Social Protection of the Republic of Belarus
The Decree of the President as of 31.12.2015 No. 534 “On issues of social insurance" (hereinafter - the Decree) made some amendments in the procedure of contributions payment on compulsory state social insurance, as well as amendments and additions to the Regulation on payment of compulsory insurance contributions, contributions to the professional pension insurance and other payments to the budget of the state non-budgetary fund of social protection of the Republic of Belarus, approved by the Decree of the President of the Republic of Belarus as of January 16, 2009 No. 40 “On Social Protection Fund of the Ministry of Labor and Social Protection”.
Survey of the main amendments
1. The range of subjects subject to compulsory state social insurance has been extended.
Thus, foreign citizens and stateless persons working in the Republic of Belarus or acting as individual entrepreneurs are subject to compulsory state social insurance under the conditions established by the legislation for the citizens of the Republic of Belarus.
Please note that previously, foreign citizens and stateless persons working in the Republic of Belarus had the right to pay the compulsory insurance contributions. A so-called “declarative principle” was used, which was expressed in the fact that such individuals could express their will to pay for them contributions by writing a corresponding application.
At the moment to write such an application is not necessary, and insurance contributions are obligatory to be paid for foreign citizens and stateless persons working in the Republic of Belarus.
2. Representative offices of foreign organizations operating in the territory of the Republic of Belarus are included in the list of payers of compulsory insurance contributions to the fund budget. Appropriate changes have been made to the Regulation on payment of compulsory insurance contributions, contributions to the professional pension insurance and other payments to the budget of the state non-budgetary fund of social protection of the Republic of Belarus, approved by the Decree of the President of the Republic of Belarus as of January 16, 2009 No. 40 “On Social Protection Fund of the Ministry of Labor and Social Protection”.
Correspondingly, since 01.01.2016, the representative offices of foreign organizations operating in the territory of the Republic of Belarus will be subject to registration as a payer of compulsory insurance contributions to the budget of the Social Protection Fund of the Ministry of Labor and Social Protection of the Republic of Belarus.
Please note that the Decree comes into force from 01.01.2016.
