Representation of an Austrian company before the Commercial Court of the Republic of Belarus
The REVERA team represented a European company acting as the Defendant in a dispute with a Belarusian resident concerning the non-delivery of prepaid goods. The core issue of the dispute was the recognition of force majeure circumstances invoked by the Client in connection with the imposition of restrictive measures that prevented the delivery.
REVERA’s lawyers developed a defence strategy based on proving that the counterparty had been duly notified and that the Client had complied with the contractual deadlines for informing the other party of the impossibility of performance.
Proving force majeure in the courts of CIS countries is a complex task requiring in-depth knowledge of local legislation and international practice.
