We conduct advertising games according to new rules

On January 26, 2024 The President of Belarus, Aleksandr Lukashenko, signed Decree No. 29 that amends Decree No. 51 as of January 30th, 2003 On Organization of Advertising Games in the Republic of Belarus.

Among the core innovations we underline the following:

The procedure of conducting advertising games has been simplified if the prize fund does not exceed 40 basis units.

Advertising games with the prize fund less than 40 basic units (1,600 BYN), are not obligated to be registered in the Ministry of Antimonopoly Regulation and Trade.

Moreover, for such advertising games, there is no need to create a commission for conducting the advertising game and to publish the rules for conducting the advertising game in the print media before its conduction.

The possibility of forming a prize fund using gift certificates

When forming a prize fund using gift certificates, the latter will be considered fully formed if:

A) gift certificates will be paid by the game organizer and will be kept by him

or else

b) Before the start of the game, the organizer will transfer money in the amount of the nominal price of the certificate to a special account if the organizer himself will provide goods, render services, or perform work under the certificate.

In the previous version of the Regulation on the conduct of advertising games on the territory of the Republic of Belarus, only cash and other property (works, services) were allowed as sources of forming the prize fund.

It is possible to post information about the results of the advertising game on the Internet resource instead of print media, if the advertising game was conducted using the specified Internet resource.

Previously, it was permitted to inform about the results of an advertising game on the Internet by posting lists of winners only in cases where there were more than 100 winners in the advertising game. Other information about the results of the game still had to be published in the print media.

A ban on the placement of advertisements for an advertising game before the publishment of the rules of its conduction in print media.

Previously, there was no such ban.

The list of responsibilities of the advertising game organizer is expanding.

Now the organizer will be obliged to ensure:

  1. participation in the advertising game only through Internet resources registered in accordance with the legislation of the Republic of Belarus (if the advertising game is conducted through an Internet resource);
  2. payment of earnings within a month from the date of recognition as the winner and at least on one day off during this period.

In the event of the death or recognition of the incapacitation of the winner of the advertising game, the right to receive the prize may be exercised in the established manner by the legal successors (guardians) of the participant in accordance with the law.

A ban is being introduced on the issuance of winnings to individuals involved in terrorist activities on the date of issuance.

In addition to the winners of the advertising game, the ban applies to their heirs, guardians or legal representatives.

The registration period of the MART advertising game is being reduced from 15 days to 10 days.

The specified changes will come into force on April 27, 2024. Advertising games that started operating before the changes came into force will be completed according to the previously existing rules.
