Pre-trial settlement of a domain dispute

The Russian subsidiary of the large Chinese brand, holding an exclusive license to use the trademark in Belarus and Russia, discovered that one of the local distributors was using the mark without authorization in a domain name and on the associated website. The client’s independent attempts to resolve the issue amicably had been unsuccessful.

The REVERA team developed a pre-trial settlement strategy, prepared and sent claims to the domain owner, and collected supporting evidence, including notarial certification of electronic evidence and requests to international organizations. In addition, the lawyers prepared a statement of claim for potential submission to court, which strengthened the client’s negotiation position and allowed the matter to be resolved without litigation.

As a result of the negotiations, the domain name owner voluntarily agreed to transfer the administrative rights to the client. The client successfully restored its exclusive trademark rights without going to court, avoiding both litigation costs and time delays.
