Recognition and Enforcement of a Foreign Court Judgment for a Leading Uzbek Bank

REVERA’s lawyers advised a leading Uzbek bank on the recognition and enforcement in the Republic of Belarus of an Uzbek court judgment for the recovery of more than USD 200,000.

The project included full support throughout the cross-border process:

• pre-trial risk assessment;

Complexity

The case was highly complex: it was reviewed twice on the basis of newly discovered circumstances, which required careful coordination between the jurisdictions and an analysis of the impact of the Uzbek court decisions on the enforcement strategy in Belarus.

1. a comprehensive analysis of cross-border risks was carried out, including an assessment of potential obstacles to the recognition and enforcement of the foreign judgment;
2. a litigation strategy was developed, with an emphasis on minimising risks and protecting the client’s interests in both jurisdictions;
3. ongoing coordination of legal positions and actions between the courts of Belarus and the authorities of Uzbekistan was ensured;
4. recommendations were provided on the management of risks associated with time-related, procedural and regulatory constraints in both countries.
