Successful Defense of an International IT Distributor in an Employment Dispute with a Top-Level Executive

The Main Case

REVERA lawyers, together with LBP Law Office, successfully represented the interests of a leading regional distributor of IT equipment and solutions with a broad presence in Eastern Europe and Central Asia, in resolving an employment dispute with a former director, within the framework of judicial proceedings before the Georgian courts at both the first instance and appellate levels.

Background of the Dispute

The corporate conflict involved the Client’s former director, who filed a claim seeking recovery of substantial compensation, alleging unlawful termination of his employment contract. The dispute concerned:

  • the lawfulness of the dismissal;
  • the validity of the compensation payment, which the former executive considered to be due to him under the terms of the employment and corporate relationship.
Disputes of this nature – particularly those arising at the intersection of corporate and employment law – frequently involve a high degree of legal uncertainty: it is necessary to account for the provisions of corporate legislation, the terms of the company’s internal regulations, as well as to preclude attempts to exploit procedural tactics in order to obtain undue advantage.

Defense Strategy

The Court of Appeal dismissed the former director’s claims in their entirety on all material grounds, which enabled the team to:

  • confirm the propriety of the actions taken in the course of the dismissal;
  • avoid substantial financial liability arising from unsubstantiated claims.

Due to defence’s activities, the court absolutely acquitted the charged official in one episode. The other episode was re-qualified for p. 1 art. 431 (crime without recurrence).  Period under guard during the preliminary investigation and during the legal investigation was accounted as a partial term for servicing punishment, and on the day of judgment the defendant was released from under guard in the court room.
