In addition to promoting and popularizing their own brand, many companies invest significant financial, time and intellectual resources in the development and promotion of their own technologies, designs of the products they produce.

1. Elaboration of a strategy for the protection of industrial property rights in Belarus and all countries of the world based on the client's needs

  • The preparation of recommendations to the client on the best option for the protection and registration of industrial property rights in terms of the products and jurisdictions of interest, based on local requirements and features, as well as the features of the product itself.
     

2. Support for the preparation and filing of applications for obtaining patents for inventions, utility models, industrial designs (designs) in Belarus and all jurisdictions of the world, support for registration of computer programs, where permitted

  • Working together with the client and local patent attorneys (if necessary) on options for preparing and filing applicationы for registration of the relevant IP object based on the client’s requests and the jurisdictions of interest, as well as the requirements for registration.
  • Registration and filing of an application in the jurisdiction of interest or under the international procedure.
  • Informing about the result, working with requests and revisions, sending patents and decisions.
     

3. Preliminary check for patent clearance

  • A preliminary check of the object developed by the client for novelty and conflict with the priority rights of other persons in the territories of interest.
  • Identification of risks and preparation of recommendations for their mitigation and possible options for action.
     

4. Application status monitoring, verification of compliance with deadlines, constant informing the client about the application status

  • Constant monitoring of the application status in terms of deadlines and the procedure for its consideration by local authorities.
  • Interaction with local attorneys, responses to formal requests and requests for substantial examination.
  • Preparation and forwarding of powers of attorney, if necessary, payment of official fees and services of local attorneys in the interests of the client, if necessary.
     

5. Work with registered objects of industrial property rights

  • Maintaining industrial property rights in force.
  • Payment of official fees in the interests of the client.
  • Updating register data (preparation and filing of petitions for amendments to the relevant registers).
  • Informing about the result.
     

6. Work with oppositions from third parties upon their receipt and preliminary refusals to register industrial property rights if they are issued

  • Analysis of received oppositions and issued refusals for their overcoming.
  • Development of possible response options together with the client.
  • Preparation and filing of petitions for review of the refusal decision, responses to filed oppositions and received requests.

7. Preparation and filing, on behalf of the client, of oppositions against registered industrial property rights of competitors that violate the exclusive rights of the client, conducting the procedure for considering oppositions

  • Analysis of the situation and prospects for challenging the registration of an industrial property right of a competitor.
  • Preparation and filing of oppositions against the registration of an industrial property right in the relevant jurisdiction.
  • Participation or coordination of participation in the process of considering the filed oppositions in the relevant authority.
    In Belarus — the Appeal Board of the National Center for Intellectual Property of the Republic of Belarus.

8. Protection of rights to industrial property objects of clients from violations

  • Identifying potential violations and the persons who committed them.
  • Collecting and filing evidence of violations, preparing claims and notifications of rights to potential violators.
  • Preparing statements of claim against violators and submitting them to the competent authorities.
    In Belarus — the Judicial Collegium for Intellectual Property of the Supreme Court of the Republic of Belarus.
  • Representing or supporting the representation of the client’s interests during the consideration of these cases in court, coordinating the work of local representatives.
     

9. Support for the transfer of rights to industrial property objects under license agreements, assignment agreements, and franchise agreements

  • Preparing or checking and adjusting drafts of relevant agreements.
  • Coordinating and finalizing draft agreements based on the client’s wishes and legal requirements.
  • Supporting the registration of these agreements (in cases provided for by law).
     

10. Support for the registration of geographical indications and names of places of origin of goods

  • Preparing a set of necessary documents together with the client.
  • Preparing and submitting an application to the competent authority of the country of interest.
  • Coordinating the work of local representatives.
     

11. Support in establishing a trade secret regime for know-how and its transfer under agreements

  • Analysis of the client’s situation and existing know-how.
  • Development of a protection strategy, preparation of the necessary documentation package to establish a trade secret regime at the client’s enterprise, and drafting of agreements for the transfer of know-how.

12. Other issues related to the protection of rights to industrial property objects
